Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the TextMeAndGrow service, including our SMS and WhatsApp service at 1-858-398-5975, the websites textmeandgrow.com and textly.info, and any subdomain we publish on your behalf (collectively, the “Service”). By using the Service you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and authorized to act on behalf of the business you represent. You are responsible for keeping control of the phone number registered to your account and for all activity that occurs through it.

2. The Service

TextMeAndGrow lets business owners update their website and Google Business Profile by sending text messages. You text us instructions and content; we make the corresponding changes. We do not respond to your customers or operate as a customer support channel for your business.

3. Free trial and subscription

  • New accounts receive a free trial during which the published site is live for up to 30 days.
  • We will send SMS reminders before the trial ends. If you do not subscribe by day 30, we unpublish your site, delete your subdomain, and soft-delete your personal information; hard deletion occurs on day 37.
  • Subscribing before expiry stops the trial clock and keeps your site live. Subscription pricing, billing terms, and renewal behavior will be presented to you at the time of purchase.

4. SMS terms

By texting our number you consent to receive SMS messages from TextMeAndGrow related to your account, including verification codes, change confirmations, trial reminders, and service alerts. Message frequency varies based on your usage. Message and data rates may apply. Reply HELP for help. Reply STOP to unsubscribe at any time.

5. Acceptable use

You agree not to use the Service to:

  • Violate any law or third-party right.
  • Publish content that is unlawful, deceptive, infringing, hateful, sexually explicit, or that promotes violence.
  • Send spam, conduct phishing, distribute malware, or abuse our SMS infrastructure.
  • Misrepresent the business you operate or impersonate another business or person.
  • Reverse engineer, scrape, or interfere with the Service or its security.

We may rate-limit, suspend, or terminate accounts that violate these rules. We may also remove content that violates these Terms or applicable Google Business Profile policies.

6. Your content and licenses

You retain ownership of the business information, photos, videos, and other content you send us (“Your Content”). You grant TextMeAndGrow a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, publish, and display Your Content solely to operate the Service on your behalf, including publishing to your website and Google Business Profile.

You represent that you own or have the rights to Your Content and that publishing it via the Service does not violate any third- party rights or laws.

7. Google Business Profile

When you connect your Google Business Profile, you authorize TextMeAndGrow to read and write profile data on your behalf. You may revoke this access at any time from your Google account. Your use of Google services is also governed by Google’s terms.

8. Third-party services

The Service relies on third parties including Twilio, Supabase / Lovable Cloud, Cloudflare, Google, and AI model providers. We are not responsible for outages, data loss, or actions of these providers beyond our control, but we will use commercially reasonable efforts to keep the Service running.

9. Fees, taxes, and refunds

Subscription fees are billed in advance and are non-refundable except where required by law. You are responsible for applicable taxes. We may change pricing with at least 30 days’ notice before your next renewal.

10. Termination

You may cancel at any time by texting us “cancel” or emailing support@textmeandgrow.com. We may suspend or terminate your account if you violate these Terms, misuse the Service, or fail to pay. On termination we will unpublish your site and delete your data per our retention schedule described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MESSAGES WILL BE DELIVERED WITHOUT DELAY.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTMEANDGROW AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM AND (B) US$100.

13. Indemnification

You agree to indemnify and hold harmless TextMeAndGrow from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by SMS to active users and posted here with a new effective date. Continued use of the Service after changes take effect constitutes acceptance.
